Record Companies Are Now Suing Mobile Carriers For Royalties

Record companies have apparently found a new tactic to cash in on royalties. As we are well aware, at first these businesses sued individual users who illegally downloaded music. But this approach to collecting money in order to recover from major financial loss has destroyed their public image.

Rather than lowering the cost of albums in order to compete with free music circulating through the internet, record companies have turned to collection agencies who are now suing cellphone companies over royalties from ring tones. They contested that ring tones counted as public performances and therefore cell phone companies should be obligated to pay performance fees. The courts quickly shot this down.

Despite this unsuccessful attempt to collect on royalties, Broadcast Music Inc is now suing T-Mobile over ring back tones, claiming that the mobile carrier is selling them without licensing agreements. Unlike ring tones, which play out loud when someone calls a cellphone, ring back tones play specifically to the person calling. In other words, instead of hearing a cellphone dialing, the caller will hear a song that was chosen by the cell owner.

Cynics are quickly to point out the seeming irony of this lawsuit. Ringtones which can be heard by anyone around a cellphone do not count as a public performance, so it seems ridiculous to sue the mobile carriers over a ringback tone that can be heard solely by the caller. The music industry, suffering from major financial losses, seems to be grasping at straws in order to collect any money that they possibly can.

It does not seem that lowering the cost of CDs and DVDs is an idea that has occurred to the major companies. There are still a number of music fans out there that prefer to collect and own the media, however with prices constantly spiking, downloading music for free seems very tempting. CDs generally go on sale for about seventeen dollars.

Specific bands have been skirting the issue of music downloading through unique tactics. Radiohead, an alternative rock band, established a website where fans can download the music for free, or for a donation. Nine Inch Nails’ Trent Reznor has followed suit. With record companies’ unsuccessful lawsuits and declining public image, it seems as though thinking outside of the box and fair pricing may be more effective than bullying money out of mobile carriers and individual users.

Saints Top Dolphins To Remain Undefeated

With an offense that can strike as quickly as the New Orleans Saints’, they’re never out of a game. The Miami Dolphins found that out the hard way on Sunday as the Saints came roaring back from a 21 point deficit to win going away 46-34. Drew Brees threw for 298 yards and a touchdowns, though gave up three interceptions as New Orleans remained undefeated at 6-0 despite trailing in a game for the first time this season.

Adding insult to injury for NFL betting enthusiasts who backed Miami as +6 home underdogs, the Saints continued their rampage against the pointspread with a late game interception return for a touchdown to cover. New Orleans is 6-0 against the number this season, while Miami dropped to 2-4 against the spread.

After the game, Brees said that his team never lost confidence:

“There was no doubt on our sideline we would come back and win. They had given us their best shot, and we had played about as bad as we could play. All we had to do was string together a few drives and gain the momentum back. We knew it was going to happen, and it did.”

Following a rushing touchdown that gave his team their first lead of the game in the fourth quarter, Brees dunked the football over the goal post crossbar:

“There are times in the game when a team just needs an emotional lift. I felt like I had to do something to get everybody hyped. The first thing that came to mind was to dunk it.”

Saints’ linebacker Scott Shanle suggested that the game could portent good things to come:

“It can be a season-defining win. This was a test we hadn’t faced yet, and we couldn’t be happier with the way we responded.”

A dejected Ricky Williams explained how his team had lost:

“This was our game to win. We fought and we fought. They just fought harder at the end.”

Dolphins’ QB Vonte Davis said the defense was aware that with Brees in the game even a 21 point lead was tenuous at best:

“With Drew Brees, it’s like the score is 0-0. We knew they would come back and that it would be a tough game.”

The Saints will now host the Atlanta Falcons next Monday night. New Orleans is a -9 home favorite with the total set at 53′. They’ll then face two struggling teams, taking on the Carolina Panthers at home the following Sunday and playing against the Rams at St. Louis on November 15. The Dolphins will play on the road against the New York Jets this Sunday, with Miami a +3′ road underdog and the total set at 40′. They’ll play at New England the following Sunday before returning home on November 15 to take on the lowly Tampa Bay Buccaneers.

What Lessons You Can Learn From The King Of Pop’s Last Moon Walk

The King of Pop, Michael Jackson, has been widely known for his popular moon walk. It is a dance step wherein he has been associated with. Wikipedia defines the moon walk as “a dance technique that presents the illusion of the dancer being pulled backwards while attempting to walk forward.”

Looking at the dance and the definition behind it, I was able to see a moral lesson between Michael Jackson’s final years of his life and his moon walk. Please take not that I have no intentions whatsoever to mock Michael Jackson, but only to illustrate the lessons we can learn from his life and his famous moon walk.

Considered to be the most successful entertainer of all time, Michael Jackson sold over 750 million records and won several major awards including 13 Grammies and 13 number one singles. All his lifetime earnings were estimated to be around $ 500 million and this does not even include his music catalog holdings which is rumored to be over a billion dollars worth.

In spite of all the fortune and fame he gained, struggles of depression and debt wreck havoc in the last part of his life. To some people, his two year seclusion of himself from his family and friends and his struggles with money worsened his fragile health. Ironically, he was a person loved and adored by his millions of fans, yet he passed away broken hearted, miserable and lonely.

I refer to the King of Pop’s final years on this world as his last moon walk. Like his moon walk, Michael Jackson’s life failed to move forward because he was being drawn backward by the circumstances of his life. But unlike the moon walk, all the drawbacks in his life were not mere illusions. Below are three lessons in life which I have taken from the King of Pop’s final moon walk.

1.) Don’t spend more than what you have - Even though the King of Pop, Michael Jackson, earned more than a million dollars each year, it was said that he spent more than $20 to $30 million more than what he earns only to support his luxuriant lifestyle. This type of lifestyle brought about financial problems during the latter part of his life. Many wealthy people, such as a Bahrain sheik, charged the King of Pop of neglecting to pay debts he owed. The King of Pop also lost Neverland Ranch, a place beloved to him. Even though his assets weigh more than his debt, the King of Pop died leaving more than $400 million of debt. Yes, he may the right to live luxuriantly and as a “star” he seemed to deserved it, but the King of Pop could have learned to live within what he earns and had his other assets wisely taken care. His failure to employ such strategy not only added problems but also heightened his depression.

2.) Life is tough, so learn to handle problems - The King of Pop may have accomplished so much success in his musical career, however, he could not handle a problem well. When problems came, he became so depressed that he turned to weird plastic surgeries, isolation and drug misuse. An example of this was when he was accused of child molestation. The King of Pop was never the same after the that ordeal. According to J Randy Taraborrelli in an article he wrote for the daily mail, “He (King of Pop) surrounded himself with children, animals and a false reality - so much so that he never learned how to cope in the real world. He never wanted to grow up, and his managers encouraged these eccentricities when they should have encouraged therapy.”

3.) True happiness and joy never came from fame and fortune - Despite what the records and others say about Michael Jackson’s successes as an entertainer, it cannot hide the fact that his last days in earth was not filled with satisfaction and peace. Yes he may have broken records, evolved the music industry, pierced through racial barrier or gained the love of millions of fans around the globe but he died with so much depression, the feeling of unloved and unhappy. His is isolation from his family and friends did not even help him at all but in fact worsened his problems.

Michael Jackson’s last moon walk bears so many morals in life. I could have said more but it is your turn to do your own analysis. I pray that in the event we will have to do our last moon walk here on earth, it would be much better than Michael Jackson’s.

The following report should be received as a testimony, not as doctrine or principle. God is creative and does with each person as He desires. You will not find Instrumental Music 2.0 by trying to imitate a particular experience, but rather by encountering the Fountain of Living Waters… God.

THE DOOR TO THE SUPERNATURAL

There is the natural realm and the realm of the Spirit. A heavenly door connects both worlds… this door was very real for the apostle John (Rev. 4:1-2). He looked and saw an open door in the heavens, and a voice said unto him, “come up here”. Like if God was saying, “Down there you are not going to be able to see anything, you need to come up here; you have to pass through the door and enter into My world.”

John, before this experience heard Jesus say, ‘I am the door…’ (Jn. 10:9), but now, he could understand the magnitude of what the Master had said.

When John passed through the door, he left the world of reason and entered the world of the Spirit… He left the natural in order to enter the supernatural. In the twinkling of an eye, John found himself before the throne of God and beheld the worship of heaven. Was this experience just for John? Of course not…

DEFINING INSTRUMENTAL MUSIC 2.0

It is not easy to describe it, but while I am ministering to the Lord with the piano (during a corporate worship service or in my personal devotions), there are moments in which He opens a door in the realm of the Spirit and invites me to come up.

Upon passing through the door… it is no longer I following Him, but rather He carries me. The harmony and the melody begin to flow with an indescribable freshness, difficult to express.

It is like a powerful river of which I am in the middle and its current takes me wherever it wants. It is like extending my wings and flying impulsively on the wind without limits or pressure, in perfect liberty.

SOARING IN THE HOLY SPIRIT LIKE AN EAGLE

The Scriptures declare: “Those who wait upon the Lord will rise up wings like eagles.”(Is.40:31). The eagle extends its wings and surrenders itself to the power of the wind, at high levels, where the air currents are very strong. She moves its wings to reach the level of the current, but when it gets there, it extends its wings and allows the wind to propel it along.

In this way, the eagle arrives to heights that could not be reached otherwise. Something similar happens in the realm of the Spirit…

I can extend my wings and surrender myself to the wind of the Holy Spirit without any effort because it is He who moves me. In doing so… the harmony reaches new heights and then descends majestically. After descending, many times the music will begin to intensify (in crescendo) again, gaining more strength and power in proportion to the increase of the Spirit.

It is as if the Lord (above all, in services of corporate worship) wraps up all those present in His wings, lifting them to new heights of the glory of God. This instrumental music becomes inexpressible, powerful, majestic, and glorious.

At other times, it is as if the Cloud rests upon a chord, giving it sharpness and depth and bringing a holy silence to the place. Then He begins to descend like sweet dew, full of the presence of God. (Ps. 133:3). The music flows and tenderizes the hearts of the people, preparing the ground so that the seed of life will fall on good earth. As the book of Numbers declares: ‘And when the dew fell on the camp in the night, the manna fell on it’ (Num. 11:9). When the dew of His presence drenches the human heart, then it is ready to receive divine nourishment- the Word of God.

This powerful heavenly music finds different expressions through every prophetic musician. What I’ve shared it’s just the testimony of my own experience-which is just a drop in a big ocean…

It takes all of us to express the fullness and richness of this heavenly sound.

Oakland Shocks Visiting Philadelphia For Second Win Of NFL Season

The Oakland Raiders scored the only touchdown of the game in the first quarter and then prevailed in the kicking duel that followed en route to a–9 upset of the visiting Philadelphia Eagles. Much maligned quarterback Jamarcus Russell played his best game of the season despite two interceptions, throwing for 224 yards and a touchdown. Oakland now stands at 2-4 while Philadelphia slid to 3-2.

NFL betting enthusiasts who backed the Raiders as a whopping +14 home underdog were never in any trouble as Oakland took the lead late in the first quarter and never relinquished it. Oakland evened their mark against the NFL pointspread at 3-3, while the Eagles dropped to 3-2 against the number.

After the game, Raiders’ coach Tom Cable said for the first time all season his team focused their intensity in the right direction:

“We went out and threw a fight on somebody and said, ‘Enough. Let’s play. That’s all you can say. There’s no magic words or anything like that.”

Last week’s 44-7 loss to the New York Giants may have served a wakeup call to the Raiders. In particular, they were offended by comments made by Giants’ linebacker Antonio Pierce that the game ‘felt like playing a scrimmage’. Raiders’ wide receiver Louis Murphy didn’t dispute the comments but instead took them to heart:

“That gave me extra fuel. You have to look yourself in the mirror and man up. His comments were true. We played flat. We didn’t play with any emotion. This game was totally different. We took those comments to heart.”

The Raiders’ defense received the bulk of the credit for the victory as they pressured Donovan McNabb all day, sacking him six times. The Eagles became the first team in three years to not score an offensive touchdown against the Raiders. Richard Seymour and Trevor Scott each had a pair of sacks, and Scott had the following observation:

“I’m sure they watched the Giants game and thought we were sorry. But all week coach Cable talked about persevering and forget the past and move forward so we can get to where we want to go.”

After the game, McNabb had little to say:

“I’m embarrassed by the way we came out here and played. We’re a much better football team.”

The Raiders will try to put together an actual winning streak as they host the New York Jets next Sunday. Oakland is a +7 home underdog with the total set at 35. They’ll play their hated rivals the San Diego Chargers on the road the following Sunday before a bye week. Philadelphia will play the Redskins at Washington next Monday night. The Eagles are a -6′ road favorite with the total set at 38′.

Arena Football League To Fold, Will Declare Bankruptcy

After canceling their 2009 season, the Arena Football League has shut down entirely and appears headed for bankruptcy. Earlier this week, the league office released a short statement indicated that it had ceased operations because owners were “unable to reach any consensus on restructuring the league over the past eight months.” The league had reached a new agreement with players earlier this year, but was unable to convince enough owners that they had a viable plan to return to profitability. The leagues statement continued that there are no other viable options available to the league right now.”

Even before the decision was made to cancel the 2009 season this past December, it had been a tumultuous off-season for the Arena Football League. It began with the resignation of long time AFL commissioner David Baker just two days before the Arena Bowl championship game. Though Baker put a positive spin on his resignation saying that he felt it was time, the timing was curious. Imagine the symbolic weight of the gesture were David Stern to resign right before the NBA finals, or Roger Goodell to step down before the Superbowl”even though Baker insisted that it the decision was strictly for personal reasons it doesnt exactly send a positive signal about the stability of the league.

In October, the owner of the New Orleans VooDoo announced that the team would cease operations”despite being one of the league leaders in attendance. In announcing that the team would fold, owner Tom Benson (who also owns the NFL Saints) suggested that the end of the five year old franchise was in no way an indictment of the New Orleans market.

A dispersal draft to reassign the VooDoo personnel was scheduled and postponed several times amid assurances from the AFL office that rumors of financial instability were unfounded.

The inability to get any consensus on a business model for the league reportedly served as the final nail in the AFLs coffin. A major problem was skyrocketing player salaries, and some sort of compensation system tied to team revenues was a necessity. That agreement was reached with the players, but a bigger schism was left between several factions of owners”primarily drawn along lines of overall wealth.

Despite the demise of the Arena Football League, it wont be the end of the road for the twenty two year old sport. The 50 yard indoor war lives on in the AF2 league which, ironically, was originally started as something of a developmental organization for the AFL. The league plays in smaller markets and has a more realistic salary structure. A number of current AFL players”and possibly a couple of AFL franchises”could end up in AF2.

NHL Scoring Machine: Phil Esposito

Though his scoring records have been obliterated by Wayne Gretzky and Mario Lemieux, former Boston Bruins/New York Rangers center Phil Esposito is still regarded by hockey cognoscenti as one of the greatest offensive players in the history of the game. He is a member of the Hockey Hall of Fame, as is his brother Tony Esposito who was a standout goaltender for the Chicago Blackhawks.

Esposito was born in Sault Ste. Marie, Ontario and his prodigious hockey talent quickly became apparent. He was signed by the Chicago Blackhawks as a teenager, and made his NHL debut in’64 quickly earning a spot on the teams top line between Bobby Hull and Marcel Dionne. In’67, Esposito was traded to the Boston Bruins along with Ken Hodge and Fred Stanfield. Within a few years Hodge and Stanfield blossomed into All Stars, while Esposito quickly took his place alongside his former teammate Hull as the best scorer in the league. Suffice to say that Boston fans were of the opinion that theyd gotten the best of the deal.

It was as a Bruin that ‘Espo’ began his onslaught against the NHL record book.. In’69, he became the first NHL player to top the 100 point mark (combined goals and assists) for the season”he obliterated the record with 126 points, which would be the first of six times that hed top the century mark. He topped 100 points in five straight seasons between’71 and’75, missing a sixth straight season by a single point with 99 in’70.

Esposito’s greatest single season was in’70-71, when he destroyed the NHL’s single season goal scoring mark with 76. That record stood until Wayne Gretzky of the Edmonton Oilers broke it in’81-82. Even now, only four other players including Gretzky have scored more than 150 points in a season and only five others have scored more than 76 goals in a season. Perhaps the most amazing element of Espositos game was the frequency with which he put the puck on net”Espo had 550 shots on goal in’70-71. No one has since come close.

In’75, Esposito was traded to the New York Rangers where his experience, intelligence for the game and nose for the puck made him a valuable component of the Broadway Blueshirts offense and he was named team captain. Until the very end of his career, he remained a dangerous scoring threat that all opposing teams were forced to reckon with.

After his retirement in’75, he remained active in hockey. He served as the GM of the Rangers before helping secure an expansion team for Tampa, Florida in’92. Esposito served as the President and GM of the Tampa Bay Lightning until’98. After stepping away from formal duties, he’s remained a very visible member of the hockey media. He hosts a daily hockey radio show on XM Radio, and has even done some acting appearing in a recurring role as a fire chief on the TV series Rescue Me.
